Abstract
The research dealt with the methods of establishing constitutions and methods of amending them with an applied study of the Yemeni issue. Where the methods of establishing Yemeni constitutions varied between grant and contract, as well as between the Constituent Assembly and the popular referendum, depending on the circumstances of each stage. As for the period of Yemeni unity and the issuance of the 1991 constitution, we find that this constitution chose the path of constitutional referendum as a method for its formation, after the formation of a joint committee from the two parts of Yemen to prepare a draft The constitution and then the constitutional project for the political leadership and the legislative authorities for both parts was presented for study and approval, and thus the method of establishing this constitution is considered the best method for
