Abstract

Abstract E-commerce starts to replace traditional commerce in variety of aspects. Thus, the Saudi legislator enacted eCommerce Law to be the first right step toward updating and upgrading the Saudi legal system to keep up with social, commercial, cultural, industrial and political changes. Since all these efforts are merely a human jurisprudence, it is subject to error and miss legislating. Therefore, the Saudi authorities took notice and start reviewing as many regulations as possible. This research titled (Saudi Electronic Commerce Law and its Regulations, Reality and Hope - Critical Study of the 1440 law) is a contribution to these efforts. The research found that it is good time to have a law governs the ecommerce in Saudi Arabia; however, nothing is perfect. Consequently, this research covered in its first part the articles on the contract, its provisions and contract’s parties. The second part was dedicated to explore the aspects e-commerce that were not covered by the law, or needs to be changed. Keywords: E-Commerce, Commercial Law, Saudi Legal System رجوع
