ملخص البحث :
يهدف البحث إلي:
1. تحديد تأثير أثر العبادة في الحكم الفقهي.
2. معرفة إمكانية الاستناد في الحكم الفقهي على أثر العبادة مجرداً عن أدلة أخرى.
منهج البحث: المنهج الاستقرائي.
مما تعبدنا الله تعالى به طلب علم الكتاب والسنة؛ رواية ودراية، ومما يقتضيه العلم العمل، ومن لوازم قبول العمل بعد الإخلاص لله تعالى المتابعة لرسوله ﷺ.
وإن مما تتابع عليه الفقهاء -رحمهم الله تعالى- الاستدلال والتعليل لما يعرضونه من أحكام فقهية، ومما وقفت عليه استدلالهم لبعض الأحكام الفقهية بكونها: أثر عبادة؛ فعقدت العزم مستعيناً بالله تعالى على جمع هذه المسائل ودراستها؛ رجاء نفع نفسي وإخواني المسلمين، فكان هذا البحث الموسوم بعنوان: المسائل التي كان مستند الحكم فيها كونه أثر عبادة. ولقد قمت بجمع المسائل التي نص الفقهاء على الاستدلال فيها للحكم الفقهي بأثر العبادة، ثم درست منزلة هذا الدليل عندهم، ومن أبرز النتائج التي توصل إليها الباحث:
- أثر العبادة له منزلة في الاستدلال، وأنه يمكن أن يكون دليلاً مستقلاً للحكم الفقهي.
- في بعض المسائل كان أثر العبادة هو مستند الحكم دون غيره من الأدلة؛ فاعتمدوا عليه في الاستدلال كما في مسألة عدم استحباب الزينة للمعتكف لصلاة العيد، ومسألة كراه إراقة ماء الوضوء والغسل في مكان يداس، وفي بعضها كان من جملة الأدلة ولم يستدل به استقالاً؛ لكن اعتبره الفقهاء وذكروه من جملة أدلتهم.

Among the things we worship God Almighty with is seeking knowledge of the Qur’an and Sunnah. Narration and knowledge Among the requirements of knowledge is work, and among the requirements for accepting work after devotion to God Almighty is following His Messenger, peace and blessings be upon him
One of the jurisprudence scholars - may God Almighty have mercy on them - continued to provide inference and justification for the jurisprudential rulings they presented, and among the things they established as inference for some jurisprudential rulings was that they were: an effect of worship; So I resolved seeking the help of God Almighty, to collect and study these issues. In the hope of benefiting myself and my Muslim brothers this research was tagged with the title: Issues in which the ruling was based on it being an effect of worship. I have collected the issues in which jurists have stated that jurisprudential rule is based on the effect of worship, and then I have studied the status of this evidence among them. Among the most prominent findings that the researcher has reached are
