ملخص البحث:
يدور موضوع البحث حول "أثر قرارات مجلس الأمن على القانون الدولي"، ويهدف الباحث من خلاله إلى بيان وشرح الآثار المترتبة على قرارات مجلس الأمن في صدد حفظ السلم والأمن الدوليين على القانون الدولي والشرعية الدولية.
واتبع الباحث فيه المنهج التحليلي، وتناول الموضوع في ثلاثة مباحث؛ الأول: لدراسة دور مجلس الأمن في حفظ السلم والأمن الدوليين طبقاً لأحكام الفصل السادس والسابع من الميثاق، والمبحث الثاني: تعرض فيه الباحث لبيان القيمة القانونية لقرارات مجلس الأمن في صدد حفظ السلم والأمن الدوليين؛ ببيان كيفية إصدارها، والآثار القانونية لها، وذلك على الصعيد الدولي.
وخصص المبحث الثالث لبيان علاقة قرارات المجلس بالشرعية الدولية من خلال ميثاق الأمم المتحدة والقانون الدولي العام؛ حيث تعرض الباحث في هذا الصدد لبيان الأساس القانوني لشرعية هذه القرارات، والشروط الواجب توفرها لتحقيق هذه الشرعية على الصعيد الدولي.
وقد توصل الباحث إلى نتائج أهمها: أن مجلس الأمن هو الجهاز الرئيس في منظمة الأمم المتحدة، وصاحب الاختصاص الأصيل بالمحافظة على السلم والأمن الدوليين، كما أن قرارات المجلس في هذا الصدد لابد أن تتوافق مع الشرعية الدولية، وأن هذه القرارات يسيطر عليها ما يسمى بحق الاعتراض عند التصويت عليها، وهو أمر يسيء لهذا الجهاز الخطير.
وأوصى الباحث بتعديل نظام التصويت في مجلس الأمن؛ بما يتوافق مع تطبيق الشرعية الدولية وفقاً لأحكام ميثاق الأمم المتحدة في القانون الدولي العام، كما أوصى بوضع ضوابط وأحكام يستنير بها مجلس الأمن عند قيامه بوظيفته على الصعيد الدولي، بالإضافة إلى التزامه بقواعد وأحكام الميثاق والقانون الدولي العام.

The research topic revolves around "The Impact of Security Council Resolutions on International Law", through which the researcher aims to clarify and explain the effects of Security Council resolutions regarding the maintenance of international peace and security on international law and international legitimacy.
The researcher followed the analytical method, and dealt with the subject in three sections: the first: to study the role of the Security Council in the maintenance of international peace and security in accordance with the provisions of Chapters VI and VII of the Charter, and the second topic: the researcher was exposed to the statement of the legal value of Security Council resolutions in connection with the maintenance of international peace and security; , and its legal implications, at the international level.
The third section was devoted to explaining the relationship of the Council's resolutions to international legitimacy through the Charter of the United Nations and public international law, where the researcher was exposed in this regard to the statement of the legal basis for the legitimacy of these resolutions, and the conditions that must be met to achieve this legitimacy at the international level.
The researcher has reached the most important results: that the Security Council is the main organ in the United Nations, and the original competence to maintain international peace and security, and that the Council's resolutions in this regard must be compatible with international legitimacy, andthat theseresolutions are controlled by the so-called right to veto when voting, which is bad for this dangerous organ.
The researcher recommended amending thevoting system in the Security Council in accordance with the application of international legitimacy in accordance with the provisions of the Charter of the United Nations in public international law, and recommended the development of controls and provisions that enlighten the Security Council when performing its function at the international level, in addition to its commitment to the rules and provisions of the Charter and public international law.
