الْـــتَّدْلِـــــــيــــــكُ بَيْنَ الْجِنْسَيْنِ وَضَوابِطُه في الفِقْه الإسْلامِيّ بَابُ النِّكَاحِ Massage and its Regulations in Islamic Jurisprudence: Between Persons of the Opposite Sex and within Marriage د. سلطان بن عبدالرحمن بن عبدالقادر العبيدان* الملخّص: تهدف الدراسة إلى بيان معنى التَّدْلِيك ومرادفاته وضوابطه عند علماء اللّغة والشَّرع والطبّ، ومعرفة أدّلة مشروعيّته، ومقاصده الشرعية، ومعرفة الأحكام الفقهيّة بالتَّدْلِيك في باب النِّكاح. وقد اتّخذت المنهج الاستقرائيّ والتّحليليّ؛ لدراسة التَّدْلِيك في باب النِّكاح؛ اعتماداً على كتب اللّغة والفقه والتّفسير والطبّ؛ لبيان عظمة الشّريعة في تشريعاتها؛ وإكمالاً للدِّراسات السّابقة. وتوصّلت الدّراسة إلى أنّ التَّدْلِيك مصطلح تَقارَب فيه المعنَى اللّغويّ والاصطلاحيّ والطبيّ، وأنّه مشروع في الجملة، وله فوائد طبيّة لجسم الإنسان، وأنّ مدار البحث على جوازه وحُرْمته في باب النِّكاح، والمحارم والأجانب، والقول بجوازه بين المحارم إذا كان ضابطها على وجه المبرّة والعلاج؛ مع ضابط أمن الشّهوة. وتظهر القيمة العلميّة للبحث في تقرير مبدأ حفاظ الشّريعة على منظومة المجتمعات من المظاهر المعاصرة؛ فبيّنت الأحكام المتعلّقة بظاهرة التَّدْلِيك، ووضْع الضّوابط الشرعيّة والعُرفيّة والصحيّة لاستخراج الرُّخص والتّصاريح لفتح مراكز ونوادي الْمَساج والتَّدْلِيك، والقيام بجولات ميدانيّة تقييميّة لها. الكلمات المفتاحيّة: التَّدْلِيك، الْمَساج، الفَرْك، الخِطْبَة، النِّكاح. Abstract: The study clarifies the concept of massage, its synonyms and regulations according to the scholars of language, sharīʿah and medicine, and identifies the evidences for its lawfulness, its legal objectives and its jurisprudential rulings within marriage. Building upon previous research, relying on books of language, jurisprudence, exegesis, and medicine, and using the inductive and analytical approach, it has been concluded that: massage has convergent linguistic, terminological and medical meanings; it has health benefits and is lawful overall; the question at issue is its permissibility and prohibition within marriage and amongst maḥrams and non-maḥrams; it is permissible amongst maḥrams as an act of kindness and for treatment, assuring there is no desire. This study’s scholarly significance appears in establishing the principle of sharīʿah preserving the structure of communities. It elucidated the rulings on massage, established legal, customary, and health regulations for obtaining licenses to open massage centers, and encouraged on-site inspections.
