المستخلص
الحمد لله رب العالمين والصلاة والسلام على رسول الله ، وبعد:
فهذا بحث بعنوان: " التطبيقات الفقهية لقاعدة درء المفاسد مقدم على جلب المصالح في مكان العدة"، وتكمن أهمية هذا البحث في ارتباطه بمقصد من مقاصد التشريع التي جاءت الشريعة باعتباره، وهو درء المفاسد مقدم على جلب المصالح.
كما يهدف هذا البحث إلى بيان أثر قاعدة درء المفاسد مقدم على جلب المصالح في مكان العدد، سالكاً المنهج العلمي في دراسة المسألة الفقهية وبيان وجه ارتباطها بالقاعدة.
وقد قسمته على مقدمة، وتمهيد، وثلاثة مباحث.
التمهيد: وفيه شرح مفردات العنوان، في مطلبين؛ المطلب الأول: معنى القاعدة وأدلتها، وما يستثنى منها. والمطلب الثاني: تعريف العِدَد وأدلتها.
ثم المبحث الأول: التطبيقات الفقهية لقاعدة درء المفاسد مقدم على جلب المصالح في المطلقة الرجعية، والمبحث الثاني: لتطبيقاتها في المطلقة البائن، والمبحث الثالث: لتطبيقاتها في المتوفى عنها زوجها.
ثم الخاتمة، وفيها أهم النتائج ومنها أنَّ قاعدة: درء المفاسد مقدَّمٌ على جلب المصالح "تمثل فرعاً من فروع القاعدة الفقهية الكبرى: "لا ضرر ولا ضرار" والتي هي عمدة للفقهاء والمفتين في تقرير الأحكام الشرعية للمستجدات والنوازل، وبالتالي فهي داخلةٌ في جميع أبواب الفقه.

Abstract
Praise be to God، Lord of the Worlds، and prayers and peace be upon the Messenger of God، peace and blessings be upon him، and after:
This is a research titled: “Jurisprudential applications of the rule of warding off evil over bringing interests in the place of the waiting period،” and the importance of this research lies in its connection to one of the purposes of legislation that the Sharia came as considering، which is warding off evil over bringing interests. This research also aims to explain the effect of the rule of averting corruption in advance on bringing interests to the place of numbers، adopting the scientific method in studying the jurisprudential issue and explaining its connection to the rule. I divided it into an introduction، a preface، and a section.
Introduction: It includes an explanation of the title’s vocabulary and four requirements: The first requirement: The meaning of the rule. The second requirement: Al-Qaeda evidence. The third requirement: exceptions to the rule. Fourth requirement: Definition of numbers.
Then the first section: Jurisprudential applications of the rule of warding off evil. It is based on bringing interests to the place of the waiting period، and it contains three requirements: The first requirement: the absolute، revocable divorce. The second requirement: the irrevocable divorcee. Third requirement: Her husband has died.
Then the conclusion، which contains the most important results، including that the rule: “preventing evil takes precedence over bringing about interests” represents a branch of the major jurisprudential rule: “No harm، no harm،” which is the basis for jurists and muftis in determining the legal rulings for developments and calamities، and therefore it is included in all chapters of jurisprudence. .
